The company ARTEUM MUSEES, a French simplified joint stock company (société par actions simplifiée) whose registered office is located at 16, rue Gaillon – 75002 Paris, registered under the number 912 789 922 at the PARIS Trade and Companies Register (hereafter “TCR”), acting on behalf of the SOCIETE D’EXPLOITATION DE L’HÔTEL PARTICULIER DE SERGE GAINSBOURG ET DE SES ANNEXES whose registered office is located at 8, square Pétrarque, 75016 PARIS, registered under the number 881 533 335 at the Paris TCR (hereafter “La Maison Gainsbourg”) and any individual or legal entity purchasing a ticket (hereafter the “Customer”), on the site accessible at the address Erreur ! The Customer acknowledges having taken note of these general conditions of sale and use prior to the validation of his/her/its order. The validation of the order equates to acceptance of the general conditions of sale without restriction by the Customer. The general conditions of sale applicable are those in force on the day of the order.

La Maison Gainsbourg reserves the right to amend these general conditions of sale and use at any time, particularly in event of a regulatory change.

La Maison Gainsbourg is made up of different places, access to which is subject to an entrance fee (hereafter the “Spaces“). Theses Spaces are:

-       La Maison Gainsbourg (Serge Gainsbourg’s house), located at 5 bis rue de Verneuil, Paris (hereafter “The House”)

-       The museum, located at 14-16 rue de Verneuil, Paris (hereafter the “Museum”)

The catering space located at 14 rue de Verneuil, Paris (hereafter the “Le Gainsbarre”) is accessible to the public irrespective of access to The House and/or the Museum. However, some events organised by Lethe Gainsbarre are subject to an entrance fee.

Article 1: Characteristics of the entrance fees

The Site offers the sale of entrance fees to visit the Spaces. Each entrance fee is documented by a digital ticket issued under the conditions described below.


Entrance fee to visit the Spaces

There are two possible entrance fees:

- “Combined””House and Museum” combined  ticket;
- “Museum only” ticket.

These tickets are only valid on the chosen day, at the chosen time, for a single entrance per Space.
The Combined ticket gives access to a visit to The House and then one to the Museum, exclusively in that order, and the Museum ticket gives access solely to a visit to the Museum (hereafter the “Visits").


Entrance fee for events organised within Le Gainsbarre

The entrance fee for a show, a concert, the showing of a film, a workshop, a conference visit or any other event organised within Le Gainsbarre gives access solely to the space where the relevant event is taking place.

Sales of the tickets defined above are processed up to the limit of the quotas available.

Article 2: Gift Card

The Site also offers the sale of gift cards allowing their beneficiaries to pay for their ticket purchases, on one or more occasions, by additionally, if necessary, using another payment method available online (the “Gift Card").

The Gift Card allows only ticketing products to be purchased on the Site in accordance with the availabilities indicated. It is documented in the form of a digital voucher containing a unique code made up of several characters.

Every Gift Card purchased on the Site is sent to the Client by email upon validation of the payment. The Customer alone is responsible for sending it to the beneficiary of his/her choice, with it being made clear that Gift Cards are not for a named individual and that any person who has a Gift Card is deemed to be its legal owner.

A Gift Card is valid for twelve (12) months from its date of purchase.

An order can be paid for with the Gift Card up to the amount of the Gift Card, until the balance has been used up or the validity period has ended. The Gift Card cannot be exchanged, amended or reimbursed. Information relating to the balance on the Gift Card and its validity date can be viewed online from the personal space of the Customer that purchased the Gift Card.

Article 3: Purchasing terms and conditions - Prices and payment methods

Available tickets are exclusively on sale online on the Site.

The Customer must log into the Site, choose a service provision and a date, with it being made clear that any ticket purchase involves the creation of a personal space or connection to an existing space. As part of the creation of an account, the Customer must provide the information needed for his/her/its identification and particularly his/her/its email address. The Customer will be allocated a login and a password and it is his/her/its responsibility to keep them strictly confidential.

The Customer then pays for the tickets chosen by using either a bank card or a Gift Card, plus, where applicable, a bank card payment.

The bank cards accepted are those expressly indicated on the Site. Maison Gainsbourg's online sales system uses the Sécutix solution and the Ingénico/Ogone secure payment service falling under the SSL protocol and the PCI DSS standard. As part of the payment, the Customer provides the information relating to his/her/its bank card via the aforementioned payment service, with it being made clear that this information is not, at any time, communicated to Maison Gainsbourg. Any fraudulent use of the Customer's payment card falls under the contractual provisions agreed between the customer and the banking institution that issued the card.

Payment by a Gift Card requires the communication of the unique code indicated on it, which must be entered in the "gift voucher" box just before accessing payment of the order.

Once payment is made, a confirmation email is sent to the Customer, at the address provided when creating his/her/its personal space, containing either the ticket or a link allowing him/her/it to print his/her/its tickets from his/her/its personal space. The Customer will also receive, by email, his/her/its customer bank card receipt sent by the Ingénico/Ogone secure payment service.

The price of the tickets is indicated on the Site in euros inclusive of all taxes and management fees. The applicable price is the price in force on the date of the order.

Orders can only be paid for in euros. The tariffs and rights to reduction or free entry are indicated on the Site.

Any payment method not provided for in the general conditions will be refused by Maison Gainsbourg.

Maison Gainsbourg reserves the right to change the prices and accepted payment methods at any time.

Article 4: Obtaining tickets

The tickets are digital and can be printed by the Customer or are accessible from a mobile device that has Internet access.

No ticket, previously purchased by the Customer, may be printed, on site, by Maison Gainsbourg's teams.

The tickets are available in the Customer's personal space once the payment of his/her order has been validated.

Article 5: Conditions for using the tickets

The tickets are only valid for the day and the time indicated on the ticket and they cannot in any way be used for another date or another time. All tickets are systematically checked at a Space's entrance by the scanning of the QR code inscribed on the ticket. The first ticket presented invalidates the copies which might be presented subsequently as each ticket only gives the right to a single entry. Any exit from the Space is definitive.

The ticket is personal and non-transferable. The ticket must be kept until the end of the service provision and it may be checked at any time. To be validated, the ticket must be presented either on a mobile device shown by the ticket holder or printed in portrait (vertical) mode, with no modification to the print size on a white A4 sheet of paper, blank on both sides. The QR code and the notices must be perfectly legible.

Any partially printed, soiled, damaged or illegible ticket will not be accepted.

Only the documents on the currently valid list indicated on the Site are accepted to justify the free entry or the reduction.

Customers furnished with a ticket undertake to make their Visit in compliance with the instructions given by Maison Gainsbourg's teams in accordance with its internal regulations, particularly regarding behaviour and showing respect for people, places and objects.

During their visit, Customers must not under any circumstances inconvenience other visitors.

Ticket holders are forbidden from selling or distributing any product or article whatsoever inside La Maison Gainsbourg.

Visitors undertake to comply with the government standards in force which apply to establishments open to the public, particularly in terms of health safety and the security of people for access to Maison Gainsbourg's Spaces.

Luggage and travel bags are not allowed. Customers are not allowed to take pictures, film or record all or part of the Visit, in Serge Gainsbourg's house at 5 bis rue de Verneuil. Food and/or drink brought in by Customers may not be consumed by them in the Spaces.

Children under 12 years old who are not accompanied by an adult cannot have access to the Visit.

In the event of non-compliance with one of the conditions set out in this Article, Maison Gainsbourg reserves the right to refuse or interrupt access to the relevant Visit or event.

Article 6: Lateness

If the Customer is late, Maison Gainsbourg reserves the right not to carry out the service provision and the customer cannot ask for the total or partial reimbursement of the amount paid or have the benefit of an exchange for a later time slot. 

Article 7: Amendment and cancellation by La Maison Gainsbourg

Maison Gainsbourg reserves the right to amend its Visits or events if all of the conditions are not met in order to offer them as they were scheduled.

Except for cases of force majeure making it impossible for La Maison Gainsbourg to fulfil its obligations, in the event of cancellation of the Visit by Maison Gainsbourg and at the Customer's request, Maison Gainsbourg undertakes to offer him/her/it a rescheduling of the relevant Visit. If rescheduling is impossible, the Customer may be reimbursed. The Customer must make the request within a period of 30 days from the date of cancellation or amendment upon submission of the ticket and his/her/its banking details (official statement of banking identity or bank card number with its expiry date), to the exclusion of any other recompense or compensation whatsoever, by email to contact@maisongainsbourg.fr.

Article 8: Fraudulent use

Duplicating or counterfeiting a ticket in any way whatsoever is strictly forbidden.

Any person that illegally reproduces a ticket and/or uses a counterfeit ticket may be criminally prosecuted.

Maison Gainsbourg will refuse access to the site to anyone with an already used (checked) ticket.

Article 9: Loss and theft of tickets

Maison Gainsbourg accepts no liability in the event of loss or theft of a ticket, including within the Spaces of Maison Gainsbourg.

Article 10: Right of withdrawal

Any ticket purchase is firm and final and the tickets purchased cannot be reimbursed, exchanged or taken back, other than in the case of cancellation of the Visit by Maison Gainsbourg.

The sale of tickets for a visit to the Spaces at the conditions stipulated in these General Conditions corresponds to a leisure activity which must be provided on a specific date or period as defined in the provisions of Article of the L.221-28 French Consumer Code. In this regard, the Customer does not have the benefit of any right of withdrawal.

A Customer that has purchased a Gift Card has the benefit of any right of withdrawal which he/she/it can exercise within a period of fourteen calendar days from the date of receipt of the corresponding Gift Card, without having to justify the reasons or pay penalties.

The right of withdrawal must be exercised by the Customer within the aforementioned period, using the form appended to this document or by any other unambiguous declaration, expressing his/her/its wish to withdraw, sent by post to: Maison Gainsbourg, Service Réclamations, 14 rue de Verneuil, 75 007 Paris.

The Customer must, within the aforementioned period, provide Maison Gainsbourg with the following information: first name and last name , order number and unique code of the relevant Gift Card.

Any withdrawal made in accordance with the conditions of this Article will give rise to a reimbursement of all of the sums paid, within a period of fourteen (14) days from the date on which the Customer informs La Maison Gainsbourg of his/her/its decision to withdraw. The sums paid will be reimbursed via the payment method used by the Customer for the initial transaction.

In the event that the Gift Card is used by the Customer or the beneficiary before the expiry of the aforementioned withdrawal period, the Customer is deemed to have expressly waived the right of withdrawal.

Article 11: Liability

Maison Gainsbourg cannot under any circumstance be held liable for any failure to perform or defective performance of the Visits that are attributable to the Customer or an unforeseeable and insurmountable act of a third party or a case of force majeure.

Article 12: Force majeure

Maison Gainsbourg will be exempt from any liability in the event that it is unable to allow the Visits for reasons arising from a case of Force majeure.

Force majeure is defined as an insurmountable and irresistible event, resulting from an external act, which consists of an event or a series of events of a climatic, pandemic, bacteriological, military, political or diplomatic nature.

By way of an example, Force majeure events include, but are not limited to, natural phenomena such as tornadoes, floods, hurricanes, earthquakes, volcanic eruptions; the spreading of a virus that would be classified by the authorities as stage 3 of the epidemic or other applicable equivalent; the use by a State or a terrorist group of arms of any sort disturbing the continuity of business relations; social unrest on a national scale; the declaration of martial law or the decision of a Government, with the participation or not of its allies, to put a sea, air and/or land blockade in place; the partial or total introduction of a lockdown or a state of health emergency.

Article 13: Complaints

Any complaint must be made in writing and sent to Maison Gainsbourg by registered letter with acknowledgement of receipt, to the following address: Maison Gainsbourg, Service Réclamations, 14 rue de Verneuil, 75 007 Paris. For any request for clarification regarding the complaints procedure, the Customer can send a request to Maison Gainsbourg's teams.

Article 14: Personal data protection

The personal data relating to the Customer and collected as part of the sale of tickets (hereafter the "Personal Data") are processed by:

ARTEUM SERVICES, a French Simplified Joint Stock Company (société par actions simplifiée) with capital of € 3,540,100, whose registered office is located at 16 rue Gaillon, 75002 Paris, registered in the Paris Trade and Companies Register under the number 808 799 704, acting on behalf of La Maison Gainsbourg, the data controller.

The Customer's Personal Data are collected and processed in strict compliance with La Maison Gainsbourg's confidentiality policy, accessible at the following address: www.maisongainsbourg.fr/en/privacy-policy

The Personal Data will not be sent to any external entity, other than those that assist in making this service available and who have undertaken contractually to comply with the confidentiality clauses.

In accordance with Law no. 78-17 of 6 January 1978 known as the "Data Protection and Civil Liberties Act" and European Regulation no. 2016/679, the relevant Customers have the benefit of the following rights:

- Right of access: the right to access the personal data which Maison Gainsbourg has as part of this processing;

- Right of rectification: the right to obtain, from Maison Gainsbourg, rectification of personal data that is inaccurate;

- Right of erasure or right to be forgotten: the right to obtain, from Maison Gainsbourg, the erasure of personal data in relation to this processing;

- Right to object: the right to object, at any time, to the processing of
personal data;

- Right to portability: the right to receive the personal data in a
structured format;

- Right to make a complaint to a supervisory authority and right
to an effective legal remedy: the right to make a claim to the national supervisory authority,
the CNIL (French data protection authority), in the event of breach of the
personal data processing.

Article 15: Settlement of disputes

These General Conditions of Sale issued in French will be performed and interpreted in accordance with French law.

In the event of a dispute, the consumer shall firstly contact Maison Gainsbourg to obtain an amicable solution.

The Customer is entitled to use the mediation service offered by Maison Gainsbourg.

In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or an answer within a period of two months, the consumer can submit his/her complaint, free of charge, to the consumer mediator. The matter must be referred to the mediator within a maximum period of one year from the initial complaint.

In the absence of an amicable settlement, the dispute will be brought before the competent French courts.
